Law contains several provision regarding maintenance of wife, child, parents, even there have provision where husband also can claim maintenance from his wife. Now days many of the wife misused this provision to extort money from her husband. In case of maintenance cases two things are clearly states in the law that if the wife taken divorce on mutual consent and if the wife withdrawn herself voluntarily from the matrimonial home then she is not entitled to get maintenance from her husband. Now days many of the cases pending before several court where the wife withdrawn herself from the matrimonial home, even the husband still continue the matrimonial life, but wife filed maintenance case and court consider maintenance.

Supreme court made one landmark judgment in the year 2018 in connection of the case Neha vs Rajnish, where court clearly define how a court determine maintenance, after coming this judgment many changes came in this proceeding.
